General Terms and Conditions

PLEASE READ THIS CAREFULLY. YOUR ACCESS TO AND USE OF HARD CALL'S SERVICES IS SUBJECT TO THE FOLLOWING TERMS, INCLUDING A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.

These Terms and Conditions (“Terms”) govern your access to and use of services provided by Hard Call (“we,” “us,” or “our”). By using our services, you (“you,” “the customer,” or “the user”) agree to be bound by these Terms in full. If you do not agree, you may not use Hard Call services.

1. Nature of Our Services

Hard Call provides third-party task execution and communication services intended to reduce stress and facilitate socially uncomfortable or time-consuming interactions. Services may include, but are not limited to:

  • Delivering messages or requests on your behalf

  • Conducting communications, research, or negotiations

  • Relaying information or responses from third parties

We act solely as an intermediary on your behalf and do not create, alter, validate, or endorse the content of your requests.

2. No Liability for User Content

You acknowledge and agree that:

  • You are solely and fully responsible for the content, tone, accuracy, and implications of any message, request, or information you instruct us to communicate.

  • Hard Call is not liable for the consequences, legal or otherwise, of transmitting your messages or executing your requested actions.

  • You represent that any content provided to Hard Call is lawful, accurate, non-defamatory, and compliant with all applicable laws and regulations.

We do not accept responsibility or liability for any damages, losses, claims, or disputes arising from:

  • Messages delivered by us on your behalf

  • Interpretations, actions, or reactions of message recipients

  • Outcomes of negotiations, research, or third-party responses

3. Customer Warranties and Indemnification

By using our service, you warrant that:

  • You have the legal right to request the service and send the communication or inquiry in question.

  • Your instructions will not violate any law, regulation, court order, or third-party right (including defamation, harassment, threats, fraud, or invasion of privacy).

You agree to indemnify, defend, and hold harmless Hard Call, its owners, agents, contractors, and affiliates from any claims, demands, damages, losses, liabilities, or costs (including legal fees) arising from your use of our service or any message or request you initiate through us.

4. No Guarantee of Accuracy or Outcomes

While Hard Call strives to act in good faith and exercise reasonable care, we do not guarantee:

  • The accuracy, completeness, or usefulness of any research or information provided

  • That your desired outcome will be achieved

  • That the recipient will interpret your message as intended

Any reliance you place on the service or any resulting communication is entirely at your own risk.

5. Monitoring and Refusal of Service

We reserve the right, but not the obligation, to:

  • Review, flag, or reject any submitted content

  • Refuse to transmit or execute any message or request that we deem inappropriate, harmful, illegal, or inconsistent with our values

However, we cannot guarantee that all misuse will be caught. Therefore, you remain fully liable for any message or instruction you initiate, regardless of our screening efforts.

6. Disclaimer of Warranties

Our services are provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim:

  • All warranties of merchantability, fitness for a particular purpose, and non-infringement

  • Any warranties regarding the timeliness, security, or reliability of our service

7. Limitation of Liability

To the maximum extent permitted by applicable law, Hard Call and its affiliates shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to:

  • Loss of profits, data, or goodwill

  • Emotional distress or reputational harm

  • Third-party disputes or claims

  • Legal or financial outcomes based on messages transmitted

This limitation applies whether based on contract, tort, negligence, strict liability, or otherwise, and whether or not we have been advised of the possibility of such damages.

8. Jurisdiction and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles.

You agree that any disputes arising from or related to your use of the service shall be subject to the exclusive jurisdiction of the state and federal courts located in Suffolk County, Massachusetts.

We make no representations that our services are appropriate or lawful in any location outside the United States. Users accessing our services from outside the U.S. do so at their own initiative and are responsible for compliance with local laws.

9. Termination of Service

We reserve the right to suspend or terminate service at any time, with or without cause, including for violations of these Terms. Termination does not limit any of our legal rights or remedies.

10. Modifications to Terms

We may update these Terms at any time by posting the revised version on our website. Continued use of the service after such updates constitutes your acceptance of the new Terms.

Terms and conditions of use – Discreet Purchasing

By using Hard Call for your Discreet Purchasing, you agree to the following terms and conditions. These terms ensure clarity, safety, and a high standard of service while protecting your privacy and our operational integrity.

1. Eligibility

Discreet Purchasing is available to users 18 years or older. You must have the legal right to purchase the items you request. We reserve the right to decline any order at our sole discretion.

2. Permitted Items

Legal in both the shipping and delivery locations

Not age- or ID-restricted (e.g. no alcohol, tobacco, firearms, or prescription medication)

Valued at $1,000 or less, excluding shipping and tax

Able to be shipped without violation of carrier rules or government regulations

Items that are considered hazardous, perishable, or otherwise sensitive may also be declined.

3. Prohibited Items

Weapons, explosives, ammunition, or parts thereof

Drugs, controlled substances, or prescription medications

Adult materials or pornography

Alcohol, tobacco, or vape products

Items requiring age or government ID verification

Products exceeding $200 in value without prior written approval

Any item that violates local, state, federal, or international law

Requests for these items will be denied. Repeated violations may result in a permanent ban from Hard Call services.

4. Processing and Service Fee

Each Discreet purchase incurs a non-refundable $29.95 processing fee, which covers:

Manual purchase on your behalf

Receipt removal and discretion management

Repackaging in plain, unbranded materials

Optional short-term storage in our secure facility

You will also be invoiced for the full cost of the item, including any taxes or retailer shipping fees.

5. Payment Terms

All orders require full pre-payment. We will not purchase any item until the invoice is paid in full. We accept payment through secure digital platforms. Once an order is placed, no cancellations or refunds are permitted.

6. Receipt and Repackaging

When we receive your item, we will:

Inspect it for damage

Remove receipts, promotional material, or identifying paperwork

Repackage it in plain wrapping suitable for discretion

Repack only what is necessary for discretion—we do not inspect or verify internal product integrity

If items are damaged upon arrival to us, we will notify you before proceeding.

7. Optional Storage

We offer complimentary storage for up to 30 days in our secure vault. After that period, a daily fee of $1.50 will apply. Unclaimed items after 60 days will be discarded or donated at our discretion.

8. Shipping

You may select from standard, expedited, or courier shipping. Once the package is handed off to your chosen carrier, Hard Call is not responsible for:

Delays

Loss

Damage in transit

Carrier errors

Tracking information will be provided when available. Insurance is available on request.

9. Privacy and Confidentiality

Hard Call protects your identity and order history. We will never share or disclose your personal details unless required by law. Your packages will arrive in plain packaging with no reference to Hard Call or the original vendor.

10. Right to Refuse Service

We reserve the right to refuse any transaction that violates our policies or creates legal, ethical, or logistical concerns. Abuse of the service, harassment of staff, or repeated policy violations will result in permanent suspension.

By submitting a request through Hard Calls Discreet Purchasing service, you affirm that you have read, understood, and agreed to these Conditions of Service.

Terms and Conditions of Customer Use – Loop

Effective Date: January 2025

These Terms and Conditions ("Terms") govern your access to and use of the Loop feedback platform ("Loop"), a service provided by Hard Call, LLC ("Hard Call", "we", "us", or "our"). By using Loop to submit or receive feedback, you agree to be bound by these Terms. If you do not agree, please do not use the service.

1. Purpose of the Service

Loop is designed to facilitate private, respectful, and constructive feedback between customers and participating businesses. It is intended to support service improvement, express appreciation, or voice concerns in a non-public setting.

2. User Eligibility

To use Loop, you must:

  • Be at least 16 years of age or have the consent of a parent or legal guardian.

  • Use the service only for lawful and appropriate purposes.

  • Agree to submit feedback that complies with the standards set forth below.

3. Acceptable Use Policy

When submitting feedback via Loop, you agree that your message will:

  • Be based on a real experience you had with the business.

  • Be respectful, honest, and constructive.

  • Avoid personal attacks or speculation about individuals.

You further agree not to submit any content that:

  • Contains profanity, threats, or abusive language.

  • Is discriminatory or hateful in nature (e.g., racism, sexism, homophobia).

  • Is defamatory, knowingly false, or misleading.

  • Promotes illegal activity.

  • Contains advertising, promotional material, or spam.

  • Is incoherent, irrelevant, or unrelated to the business experience.

Hard Call reserves the right to refuse to deliver any message, at its sole discretion, that violates these rules.

4. Message Delivery & Business Response

  • Submitted messages will be reviewed by Hard Call for compliance before delivery to the business.

  • Messages that meet our standards will be delivered to the business partner anonymously or with attribution, depending on your preference.

  • The business may respond via Loop. Hard Call will relay one reply per submission. Ongoing dialogue is not supported unless initiated as a new Loop submission.

  • Businesses do not have access to your contact information unless you explicitly include it.

5. No Guarantee of Action or Response

Hard Call and participating businesses are under no obligation to take specific action in response to feedback submitted through Loop. Submission of feedback does not guarantee a reply, remedy, or follow-up from the business.

6. Privacy

Hard Call does not collect more personal information than is necessary to deliver your message and any business response. We do not sell, share, or disclose your information to third parties except:

  • As required by law.

  • To fulfill service delivery (e.g., transmitting messages).

  • If you opt to include identifying information in your message.

7. Intellectual Property

All content provided by Loop, including logos, graphics, wording, and system design, is the property of Hard Call and may not be copied, reproduced, or distributed without express written permission.

Submitted feedback remains your content. However, by using Loop, you grant Hard Call and the recipient business a non-exclusive, royalty-free license to store, use, and respond to your message.

8. Disclaimer of Warranties

Loop is provided "as is" and "as available." We make no guarantees regarding:

  • Delivery timelines

  • Response quality or tone

  • Outcomes resulting from submitted feedback

We disclaim all warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Hard Call shall not be liable for any indirect, incidental, or consequential damages arising out of or related to your use of Loop.

  • Our maximum liability to any user for any claim shall not exceed $100.

10. Termination

We may suspend or terminate access to Loop at any time, with or without cause, and without notice, particularly if a user violates these Terms.

11. Modifications to the Terms

We may revise these Terms from time to time. Continued use of Loop after such changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

Terms and Conditions of Business Participation - LOOP

These Terms and Conditions (“Terms”) govern your participation as a recipient business (“You,” “Your,” or “Business”) in the Loop service, operated by Hard Call, LLC (“Hard Call,” “We,” “Us,” or “Our”). By accepting messages through Loop, you agree to be bound by these Terms.

1. Nature of the Service

Loop is a message transmission service. Its purpose is to provide businesses with customer feedback, whether compliments, concerns, or suggestions in a respectful and private format.

  • Hard Call does not author, edit, or alter the contents of messages submitted by customers, except to remove content that violates our policies.

  • Hard Call acts solely as a neutral conduit for message delivery.

  • The opinions expressed in messages are those of the customer and do not reflect the views of Hard Call.

2. Message Handling

  • Messages are reviewed only for compliance with our content guidelines (e.g., removing hate speech, threats, spam, or irrelevant content).

  • Hard Call may refuse to deliver messages that, in its sole discretion, violate these standards.

  • Delivered messages are relayed as submitted, and Hard Call makes no representations as to their accuracy or truthfulness.

  • A business may receive one reply opportunity per message through the Loop system. Ongoing dialogue is not facilitated by Hard Call.

3. No Guarantee of Message Volume or Content

  • Hard Call does not guarantee the frequency, volume, tone, or substance of messages received.

  • We do not verify the identity of the sender unless explicitly disclosed in the message.

  • You acknowledge that feedback may be positive, negative, or neutral and agree to receive it without expectation of moderation beyond basic compliance checks.

4. Liability and Indemnification

  • You agree that Hard Call is not liable for any consequences, emotional, reputational, operational, or otherwise, that may result from the receipt of feedback via Loop.

  • You acknowledge that we are not responsible for the actions or communications of third-party users (customers).

  • You agree to indemnify and hold harmless Hard Call, its employees, officers, and affiliates from any claims, damages, or disputes arising out of messages received through Loop or actions you take in response.

5. Confidentiality and Data Handling

  • Messages are transmitted to your designated email address or delivery method and are not made public by Hard Call.

  • You agree to treat customer feedback received through Loop with discretion and not to retaliate against any individual suspected of submitting a message.

  • Hard Call does not share sender identities unless the customer chooses to self-identify in the message.

6. Participation Materials

Each participating business may receive:

  • Physical signage or display indicating Loop participation.

  • Printed materials (e.g., branded stones) to encourage feedback.
    You agree to use these materials in good faith and not misrepresent the nature of the service.

7. Service Modifications and Termination

Hard Call reserves the right to modify, pause, or discontinue the Loop service at any time. Participation may be terminated by either party with notice.

8. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts without regard to conflict of laws principles.
